WHAT TO DO AT AN ICE CHECKPOINT, ESPECIALLY IF YOU ARE WHITE and/or FEEL THE NEED TO JAM UP THE WORKS.
Here's the deal:
π Border Patrol can verify citizenship within 100 mi. of a border or "external boundary." This includes coastlines, so PDA & SEA are within the 100-mile zone.
π Border Patrol & ICE can only ask brief questions about citizenship. They cannot hold you for an extended time w/out cause.
π You always have the right to remain silent. You do not need to answer their questions.
π WITH THAT SAID, IF YOU ARE A BORN CITIZEN OF THE UNITED STATES, ESP. IF YOU ARE WHITE, YOU NEED TO SPEAK THE FUCK UP.
π The most important acts of resistance are the small ones. Make it difficult and uncomfortable for ICE agents to do their jobs.
πThey count on citizens to turn a blind eye & allow them to deport undocumented citizens w/out challenge. Disabuse of that notion.
π If you are on a train, bus, or anything else & ICE or CBP boards, you need to stand up & loudly let everyone know that they have the right to remain silent or only answer questions in the presence of an attorney, no matter their citizenship or immigration status. There have been numerous reports that confronting the agents in this way has caused them to leave without verifying citizenship. THIS CAN SAVE LIVES. π
π If you see anyone being held up by immigration, loudly ask if they are being detained & if they are free to go.
π Immigration cannot detain anyone w/out reasonable suspicion. Agents must have specific facts about you to make it reasonable to believe you are committing or committed, a violation of immigration law or federal law. If an agent detains you, ask for their basis for reasonable suspicion, & they should tell you. Polite verbal resistance is no cause for suspicion.
π Always say no to a search. Let everyone know that they can & should refuse consent to a search.
π Agents cannot search or arrest anyone w/out facts that make it probable that they are committing, or committed, a violation of immigration or federal law.
π Silence alone is neither of these standards. Nor does race or ethnicity alone suffice for probable cause *or* reasonable suspicion.
π White citizens, your level of privilege protects you from ICE retaliation for being "rude" or making a scene. It is our DUTY to speak up & make sure people w/out the same privilege know their rights. GET LOUD. YELL. YELL IN SPANISH IF YOU KNOW IT. LET PEOPLE KNOW THEY DON'T HAVE TO SAY ANYTHING. MAKE ICE UNCOMFORTABLE. THROW SAND IN THE GEARS OF WHITE SUPREMACY.

πIt is perfectly legal to record immigration agents as long as you are not on government property or at a port of entry. If your train/bus is boarded, pull your phone out & start recording immediately.
π If detained or you see someone getting detained, get the agent's name, #, & any other identifying information; video if possible.
π Contact the ACLU or your local Immigrant/Migrant support orgs if you see someone's rights being violated. Report to Rapid Response Hotline 844-724-3737 ( UGH-RAID-REPort ).
